Telangana Chief Electoral Officer has formally informed the Election Commission of India about the Khairatabad Assembly seat vacancy, initiating preparations for a possible by-election. The communication followed a gazette notification from the Legislative Assembly Secretariat declaring the seat vacant from April 23, 2024, in accordance with judicial orders concerning former MLA Danam Nagender.
Nagender faced disqualification under the anti-defection law after winning the Khairatabad seat as a Bharat Rashtra Samithi candidate in December 2023 and subsequently contesting the Secunderabad Lok Sabha seat under the Indian National Congress banner. The Telangana High Court ruled that his disqualification took effect on the precise date he submitted his nomination papers for the parliamentary election.
Telangana Legal Battle Preceded Khairatabad EC Notification
Telangana MLA Danam Nagender challenged the High Court order disqualifying him in the Supreme Court, seeking interim relief against his removal. However, the apex court declined to stay the verdict, following which the Legislative Assembly Secretariat officially notified the Khairatabad constituency vacancy.
The Election Commission of India will determine the final schedule for the by-election after concluding ongoing electoral roll updates. Election officials indicate that polling could occur following the publication of revised voter rolls on November 9, potentially aligning with upcoming state assembly elections scheduled in early 2027.
